The committee engaged in considerable debate about the proposed pension revisions and posed questions to Mayor’s Chief of Staff Chris Hand, General Counsel Jason Gabriel and Assistant Counsel Steve Durden about the legal status of the so-called “30 year agreement” between the City and the Police and Fire Pension Fund. Council Member Crescimbeni suggested the need for a clear and unambiguous definition for the term “rate of return” and clarity about the expenses that may be netted out before calculation of that figure. The members debated the merits of adopting a plan with some less than optimal features in return for getting a new, less expensive pension plan in place to reduce the City’s annual costs in the short run.

 

An amendment proposed by Council Member Boyer to insert a sunset date for the PFPF to approve the agreement of April 30, 2015 was approved 4-3. A motion by Council Member Schellenberg to remove any reference to the Senior Staff Voluntary Retirement Plan was approved 5-2. A motion by Council Member Boyer to calculate the DROP actual rate of return over all 5 years rather than as 5 individual yearly calculations was withdrawn. A combined Rules amendment was approved 4-3.

Mr. Stelma explained the differences between operating expenses that will and will not be paid by the state court system. Peggy Sidman and Steve Durden of the General Counsel’s Office explained the process of implementing the proposed sales tax, how the funds can be used, and how it would impact on the City’s ability to set the millage rate for other purposes aside from fire and rescue services. Mr. Durden explained that the statutory language is somewhat vague and Jacksonville would be among the first jurisdictions to utilize this tax, so there is no experience or court precedents to guide the City’s actions.
