Attorney Paul Harden, agent for the applicant, explained what the proposed legislation entailed.  He noted that many of the issues had been aired when the CON was up for approval; this measure amends the existing CON. 

 

Mr. Tom Cade, the neighbor whose property is impacted by the landfill facility, reported that he was completely satisfied that Mr. J.B. Coxwell had done what he could to lessen the impact on neighbors, such as creating buffer zones.

 

Ms. Olive Ellis, whose property abuts the facility, had several concerns about the facility.  Her family is opposed to the ordinance.  She was concerned about a drop in property values.  Her brother, Scott Ellis, was concerned about the deposit of refrigerators in the landfill that would attract birds.  Mr. Harden answered that the law prohibits the facility handling refrigerators.  Scott Lockwood, England, Thims & Miller, speaking on behalf of the applicant, reiterated Mr. Harden’s contention that it is illegal for the facility to handle refrigerators.
