In the course of the Public Hearing, William F. Powell explained his objections to the CON application in this ordinance.  The operator of a  recycling facility in the vicinity of the applicant’s, Mr. Powell explained that as a trucking concern, the applicant had considerable advantages and threatened his operation.  Mr. Powell said that he foresaw the demise of his operation, to the detriment of his employees, if the CON application were approved.

 

Mr. Emir Hrustic explained how his facility met all of the requirements necessary for the CON.  He added that buffers had been erected to mitigate any noise or dust that the facility could create.

 

Jeff Foster, Chief, Solid Waste Division, Public Works, indicated that the Hrustic Brothers had met all of the conditions required for the application.  Mr. Foster explained that the County needed more recycling facilities to meet requirements of the State.  Mr. Foster recommended approval of the ordinance that would grant a CON application.

 

Attorney Brenna Durden explained that there were a number of unresolved questions with regard to the definition of particular conditions and requirements for CON applications.

Assistant General Counsel Susan Grandin further explained what the objectives of the proposed legislation entailed.  She asked William J. Schilling to further explain.  Mr. Schilling was Chairman of the Technical Advisory Committee (TAC) that was instrumental in crafting the proposed legislation.  TAC was created by Ordinance 2014-183-E, sponsored by Council Member Lori Boyer.
