17-420

Amendment

(Rezoning 12900 Broxton Bay Dr & an Adjacent Property from PUD to PUD): Per OGC, approves rezoning subject to conditions:

(1)        The development contemplates fourteen apartment buildings to house residents.  Prior to the first final inspection of the 8th through the 14th apartment buildings, the owner or their agent shall complete the construction of Nautica Drive as shown and located on Exhibit 2 to this ordinance, and page 2 of Exhibit 4 of this ordinance.  Nautica Drive is also identified by the Duval County Property Appraiser’s Real Estate No. 106609-5230.  Nautica Drive shall be constructed to City standards, and must be dedicated and accepted by the City prior to the final inspection of the 8th through the 14th apartment buildings.  It is the intent of this Council that rather than Nautica Drive remaining a private road that it be accepted by the City as a public right-of-way.

(2)        Nautica Drive shall remain open to the public.

(3)        The four driveway aprons from the outparcels along Airport Road shall remain and provide vehicular access to Nautica Drive from the outparcels, in order to allow internal circulation between the outparcels and the larger shopping center use.

 

Adds a new Section 4 to the ordinance stating that it is the intent of the Council that Nautica Drive be accepted by the City of Jacksonville as a public roadway if the road is constructed to City standards and is accepted as such.

Amendment

(Rezoning 15199 Main St N from CCG-2 & RLD-120 to PUD): Per OGC, approves rezoning subject to conditions:

 (1)       The access point along Kirk Road shall be eliminated and access to the property shall be limited to Main Street North.

(2)        The rear setback for structures along the east property line shall be no less than twenty (20) feet.

(3)        A minimum, ten (10) foot landscape buffer shall be maintained along the east property line.

(4)        All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one-half (.5) foot candles (“f.c.”) when the building or parking areas are located adjacent to residential areas, and shall not exceed one (1.0) f.c. when abutting other non-residential properties. All lighting lamp sources within parking and pedestrian areas shall be metal halide, compact fluorescent or LED. The maximum light pole height in all parking areas should not exceed twenty feet (20’- 0”). The developer shall mount light fixtures on canopies so that the lens cover is recessed or flush with the bottom surface (ceiling) of the canopy. An exterior lighting design plan, including a photometrics plan, pole and fixtures schedules shall be submitted at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department.

(5)        Prior to requesting a final building inspection or occupying the facility in any manner, the owner, applicant, or developer shall submit to the Planning Department separate certification letters confirming that all horizontal and vertical components of the development have been substantially completed, and al conditions to the development order have  been satisfied. This condition shall apply to both phased and non-phased developments. Prior to the first final inspection within any phase of development, the owner of their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied or (b) a detailed agreement for the completion of all condition to the development order.

(6)        Notwithstanding anything stated in the October 23, 2017 Written Description, landscaping will be provided along the buffering side and rear  yards, including Kirk Road, as depicted in the Site Plan using the species and spacing described in the Written Description.

Amendment

(Rezoning Property on Philips Hwy bet St Augustine Rd & Race Track Rd from PUD to PUD): Per OGC, rezoning approved subject to conditions:

(1)   Provide a 50-foot right-of-way stub out (to include curb, gutter and roadway) to provide ingress and egress for the existing single-family homes located near the northeast corner of the Property, as indicated on the Site Plan (Exhibit 4 to Ordinance 2017-491).

(2)   Provide a 6-foot vinyl fence along the property line where it abuts the aforementioned existing single family residences.

(3)   Work with JEA to provide adequate electrical service for the aforementioned existing single family residences.

(4)   Provide a fire hydrant near the intersection of the 50-foot right-of-way stub out in the northeast corner of the Property and the development’s internal roadway.

(5)   Work with the City’s addressing section to provide a new address plan for the aforementioned existing single family residences.

(6)   Work with the City to arrange new location for garbage pickup.

(7)   Abide by City of Jacksonville drainage requirements.

(8)   All internal roads shall have a minimum pavement width of 24 feet, excluding curb and gutter.

(9)   Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order.

(10)           Maximum lot coverage on 40’ lots shall be 50%.

(11)           Active recreation property shall be set aside, dedicated as common area, and developed for active recreation use, as required by the Recreation and Open Space Element of the Comprehensive Plan and Section 656.420, Ordinance Code.

Amendment

(Rezoning Property on NE Side of Philips Hwy, E & S of 9B Intersection from PUD to PUD): Per OGC, approves rezoning subject to conditions:

(1)        Prior to the construction of residential uses within the PUD, covenants and restrictions shall be recorded for the Property which (i) provide for architectural review of plans/elevations of home exteriors by an architectural review board and (ii) provide standards for such review, including requirements that (a) the front façade of each single-family detached home and townhome must have at least two different finishes, one being a primary finish and the secondary finish being an accent feature, (b) no vinyl siding can be used on a single family detached home, and (c) and no panel siding can be used as the primary building product on the front façade of any single family detached home. As part of verification of substantial compliance for the first residential use, such recorded covenants and restrictions shall be submitted to the Planning and Development Department for review and approval.

(2)        All internal roads shall have a minimum pavement width of twenty-four feet (24’), excluding curb and gutter.

(3)        With regard to the internal primary collector roads, developer has the option of either complying with Section 654.133, Ordinance Code, as it may be amended, with regard to sidewalks and bike paths, or, in lieu of separate sidewalks and bike paths, provide a ten (10) foot wide multi-use path along one side of internal primary collector roads. Attached as Exhibit “E-1”, to the Site Plan, is a Collector Road Typical Section dated September 18, 2017, showing the proposed 10-foot multi-use path and 6-foot sidewalk (as well as right-of-way width and pavement width) proposed for the internal collector road. A minimum five (5) foot wide sidewalk shall be provided along one side of all other internal roads. Attached as Exhibit “E-2”, to the Site Plan, is a Bicycle-Pedestrian Circulation Plan dated August 18, 2017 showing the proposed multi-use path and sidewalks on internal roads.

(1)   Active recreation property shall be set aside, dedicated as common area, and developed for active recreation use, as required by the Recreation and Open Space Element of the Compliance Plan and Section 656.420, Ordinance Code.
