17-476

Amendment

(Rezoning 5931 Atlantic Blvd. - PUD to PUD): Per OGC, rezoning approved subject to conditions:

1. All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one-half (.5) foot candles (“f.c.”) when the building or parking areas are located adjacent to residential areas, and shall not exceed one (1.0) f.c. when abutting other non-residential properties. All lighting lamp sources within parking and pedestrian areas shall be metal halide, compact fluorescent or LED. The maximum light pole height in all parking areas should not exceed twenty feet (20’- 0”). An exterior lighting design plan, including a photo metrics plan, pole and fixtures schedules shall be submitted at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department.

2.Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either: (a) an affidavit documenting that all conditions to the development order have been satisfied; or (b) a detailed agreement for the completion of all conditions to the development order.

 3. The portion of the property that shall remain undeveloped is depicted on the site plan as “PUD Zoning LDR Land Use.”

(Rezoning 8165 Thor St, 8468 Highfield Ave & 0 Thor St from RMD-MH & PUD to PUD): Per OGC, rezoning approved subject to conditions:

1. The private roadway will be a minimum 50’ right of way and a minimum 24’ pavement, exclusive of curb and gutter.

2. Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either: (a) an affidavit documenting that all conditions to the development order have been satisfied; or (b) a detailed agreement for the completion of all conditions to the development order.

Amendment

(Rezoning 4578 San Jose Blvd - PUD to PUD): Per OGC, rezoning approved subject to conditions:

1.A restaurant is a permitted use, without drive-in or drive-through facilities, pursuant to the following conditions:

(a)    A restaurant, provided that its total enclosed square footage is equal to or less than 2,500 square feet in the existing building;

(b)    So long as the number of seats in the restaurant is 70 or less, combining both inside and outside, the Subject Property’s existing parking lot fulfills the City’s Zoning Code parking requirements under Part 6 of Chapter 656, Ordinance Code;

(c)   That the restaurant employs no outside amplified music or other forms of outside amplified entertainment at any time on any given day or evening during the week. All outside music or other forms of outside entertainment shall stop at 7:00 p.m.;

(d)   The location of outside sales and service in conjunction with the restaurant shall be allowed: (i) along the San Jose Boulevard (front) side of the existing building and/or (ii) in the westerly (back yard/rear) of the existing structure so long as the existing oak tree, vegetative buffer and ten (10) foot concrete wall remain or if removed will be replaced by buffers equal to or greater than the existing wall and plant material;

(e)   The restaurant’s hours of operation shall be no later than 10:00 p.m. on any given day during the week, no later than 7:00 p.m. for service in an outside garden dining area and the outside garden dining area shall close no later than 8:30 p.m.; and

(f)    Retail sale and service of beer and/or wine for on-premises consumption in conjunction with a restaurant including outside sales and service.

2. The existing pavement shall be striped to provide a pedestrian access route from one side of the property to the other along San Jose Blvd.
