Korman Shelton of the Mayor’s office reported that City attorneys had a very
productive meeting with representatives of the Loblolly Wetlands Mitigation
Bank management company and there are hopes that the matter can be settled
outside of a lawsuit. Another meeting between the parties will be scheduled
shortly.
Council
Auditor Kirk Sherman gave brief overviews of the two audits released since the
committee’s last meeting: #790 – DAVID Compliance Audit – Neighborhoods
Department and #791 - DAVID Compliance Audit – Clerk of the Courts. DAVID (Driver
and Vehicle Information Database) is the Florida Department of Highway Safety
and Motor Vehicles’ driver’s license database, which City departments access
via a Memorandum of Understanding with the DHSMV for purposes of verifying
individuals’ identities and taking code enforcement action against vehicle
owners for Ordinance Code violations. The MOU contains requirements for City
internal control over access to and authorized use of the DAVID database and
this year the City was selected to provide an attestation of compliance with
that MOU. The Auditor’s Office conducted a performance audit in lieu of an
unsupported attestation. One employee in the Neighborhoods Department has
access to the DAVID system and no issues were identified there. Ten employees
in the Clerk of the Courts Office have access to DAVID and the audit revealed
that one employee was making unauthorized use of the system to access
information on family members. Disciplinary action has been taken against that
employee. An opportunity for improvement finding recommended that both auditees
begin filing the required quarterly reports to the state pursuant to the MOU,
which both agreed to do.

Chairman Dennis explained his desire to create a mechanism to capture the
revenue the City will realize from payments received from the bond issuer for
use in the vicinity of the project as a form of mitigation of neighborhood
impacts. He will propose separate legislation to create such a mechanism and
will hold a town hall meeting on this project next week. Finance Director
Mike Weinstein cautioned the committee that the proposal to segregate
revenues into district-specific accounts represented a very substantial
policy change and urged caution in creating such a precedent, which could be
detrimental to the overall budgeting process. He said that the administration
had serious reservations about the project to begin with and only agreed to
propose it to the Council after the developer agreed to at least make the
City whole for a portion of the tax revenue that will be lost when the
for-profit developer sells the project to a not-for-profit corporation,
taking the property off the tax rolls. Council Member Gulliford opposed doing
the transaction without the deal being funneled through the Jacksonville
Housing Finance Authority’s review process. He is developing legislation that
will require all housing finance bond deals, regardless of the issuer, to be
taken through the JHFA review process. Christopher Walker representing Investing in America’s
Veterans Foundation explained the deadline of having the TEFRA hearing by May
1st or the seller will cancel the deal. Ralph Sentillo of IAVF
described the programming his
organization provides to military veterans and reported that the South
Florida-based organization will create a local LLC corporation to manage the
project in Jacksonville. Council Member Bowman noted that, although it is the
express intent of the IAVF to house a large percentage of veterans in the
complex, there is no such requirement in the documents. He will draft an
amendment to include a written commitment to housing veterans in the complex
in the deal documents. AMEND/APPROVE
