Chairwoman Brosche announced that there would not be a public comment period during today’s meeting, but that anyone desiring to register a position for or against Ordinance 2017-15 (proposed expansion of the City’s anti-discrimination ordinances) could fill out and submit a card outside the Council Chamber. She also noted that the time limits on committee debate (5 minutes per council member initially on each action or motion, 3 minutes for a second opportunity) would be enforced.

 

Jody Brooks of the Office of General Counsel (OGC) gave a brief update on the latest status of the Loblolly Wetland Mitigation Bank. The OGC has met with the attorney for the company managing the mitigation bank under contract with the City regarding the findings of the Council Auditor’s Office’s audit of the transactions in the mitigation bank, but no agreement has yet been reached on reconciling the differences of opinion on how certain transactions and payments should properly be categorized. The OGC is preparing to issue a demand letter requiring a response from the management company.

Economic Development Officer Kirk Sherman explained that the intention of the bill is to reduce the amount of “process” details contained in the Ordinance Code and to focus the Code more on big picture goals for the Fund, with the procedural details being contained in the administrative regulations. Council Member Gulliford said that a funding source for the fund needs to be found to ensure its continuity. In response to a question from Chairwoman Brosche, Mr. Wendland described the internal underwriting guidelines now being used to evaluate projects.

Council Member Gulliford moved an amendment to add a provision for a referendum to the bill that would add a Charter provision for sexual orientation and gender identity as new protected classes, subject to approval by voter referendum. If the referendum were approved by the voters, the corresponding Ordinance Code changes would then take effect. In response to a question from the committee about whether the addition of a referendum requirement and Charter amendment would constitute a “substantial” change to the bill that would require re-referral of the bill to committees and re-advertisement for another public hearing, Deputy General Counsel Peggy Sidman stated that General Counsel Jason Gabriel, when asked that question at an earlier committee meeting, had stated that in his opinion it could be argued defensibly that such a change did not constitute a “substantial” change, but that the ultimate decision on the substantiality of the change is a policy decision for the Council to make. Ms. Sidman explained the relationship between the proposed Code and Charter changes and the effect of making the changes contingent upon passage of a voter referendum. In response to a question from Council Member Crescimbeni, Mr. Gabriel explained the 9-factor test used by a federal court to determine whether an entity qualified as a “religious organization”.

 

The Gulliford amendment failed by a vote of 2-5

 

A motion to adopt the NCIS Committee amendment to increase the threshold defining a “small business” from 15 to 50 employees failed by a vote of 3-4

 

Council President Boyer explained an amendment by Council Member Crescimbeni proposed in but not adopted by the Rules Committee to revise and clarify the definition of “religious organization”. Mr. Gabriel stated that the amendment is intended to provide that the City ordinance shall be interpreted in the context of federal law and court precedents, and he does not believe that anything in the City ordinance would have any bearing on organizations with regard to their federal tax status, ability to apply for federal grants, or the like.

 

Council Member Bowman moved the amendment described by President Boyer to amend the definition of “religious organization” by striking the words “such as” and inserting instead “including but not limited to”, so as to include non-church but religiously motivated organizations such as the Salvation Army in the definition of organizations exempt from the provisions regarding sexual orientation and gender identity – the amendment was approved by a vote of 7-0.

 

Council Member Crescimbeni requested the General Counsel to provide information about whether organizations that claim the organization satisfies the definition of a “religious organization” for federal non-taxability purposes are eligible to receive federal funding, and about whether entities such as Edward Waters College (founded by and affiliated with the AME Church), the Salvation Army, and the City Rescue Mission (religiously motivated but not church-affiliated) would pass the 9-factor test and be considered “religious organizations.”

 

Charlene Hill, Executive Director of the Jacksonville Human Rights Commission (JHRC), answered questions about how discrimination complaints are filed, processed and resolved in Jacksonville. In response to a question from Council Member Newby she reported that the JHRC had received 11 complaints in the last 4 years alleging discrimination on the basis of sexual orientation or gender identity. In response to a question, Council Member Bowman, who works in business recruitment for the JAXUSA Partnership, stated that companies that explore but ultimately choose not to relocate to Jacksonville typically don’t say specifically why they chose not to come here. He said that the importance of a human rights ordinance including sexual orientation and gender identity protections varies widely depending upon the type of industry involved – for some it is a very important factor, for others it is not.

Council Member Dennis explained the purpose of his bill, which is to ensure that the City makes adequate affirmative action efforts to make its workforce more reflective of the city’s overall workforce demographics, and described what types of reports and actions the bill would require. Several committee members expressed support for and opposition to the measure. Council Member Gulliford suggested adding a 3-year sunset provision to evaluate the effectiveness of the ordinance over time and determine if it should be retained at the end of that period.
