The Committee shall
consider land use and zoning matters, including zoning; preservation;
conservation; building codes; urban renewal; real estate; land use; land, water
and wetlands preservation; water supply issues; comprehensive planning;
strategic planning; current planning; growth management and implementation of
state statutes regarding same; Planning and Development Department; appeals
from Planning Commission decisions; growth management; transportation
concurrency and mobility; school concurrency; monitoring and implementation of
the new State growth management laws; actively participate in amending and
updating Jacksonville's Comprehensive Plan, including reviewing all text
amendments and Future Land Use Map Amendments to the comprehensive plan; and
all related subjects.
If a person
decides to appeal any decision made by the Council with respect to any matter
considered at such meeting, such person will need a record of the proceedings,
and for such purpose, such person may need to ensure that a verbatim record of
the proceedings is made, which record includes the testimony and evidence upon
which the appeal is to be based.

Special Topic to be discussed: Discussion of non-controversial fixes, or “glitch” items in Zoning Code. Examples of some of these glitches are where fitness centers can go, removing antiquated language, and updating definitions for consistency with state statutes. If time permits, begin discussion on Development Standard for conventional zoning districts.

Council Member Becton declared ex parte communication with
representatives of the applicant. Wyman Duggan representing the applicant described the
history of the property, a previous unsuccessful development plan, and a
pre-existing PUD condition requiring a multi-use path giving pedestrian
connection to surrounding development, which has since changed from
residential to commercial in nature. T.R. Hainline representing the future
developer recommended a uniform width of 6 feet for the length of the path to
match the sidewalk to which it will connect at the Top Golf property. The committee engaged in considerable discussion about the
proper width of the multi-purpose path included in Condition #1; the Planning
Department originally recommended 10 feet and the applicant requested 6-10
feet, to which the Transportation Planning Division of the Planning
Department subsequently agreed. Planning and Development Director Bill
Killingsworth suggested that the path Motion (Schellenberg/2nd Morgan): amend to
recommend approval with 2 conditions and attachment of 4 exhibits (2 as
originally submitted, 1 revised written description, new transportation
planning memo) – approved 7-0 Motion (Morgan/2nd Gaffney): amend Condition #1
to require the multi-purpose path to be 8 feet wide with corresponding relief
from landscape requirements by up to 2 feet, subject to Planning Department

Council Members Carter and Becton disclosed ex parte
communication with the applicant’s agent and area residents. Curtis Hart representing the applicant described the
proposed project and answered questions from committee members. Council
Member Carter requested 100 foot setbacks behind 7 lots in the southwest
corner of the site that were originally sold as being directly on the golf
course. Mr. Hart agreed to provide a new exhibit describing those 7 lots
before the Council meeting next Tuesday. Mr. Carter requested the developer
to pursue closure of the existing entrance road into the subdivision from
Chafee Road in order to make access through a new access road that will
intersect Chaffee Road at a traffic signal. Mr. Hart will determine before
next Tuesday who owns the property adjoining the existing entrance road. In
response to a question from Chairman Becton, Mr. Hart explained the plans for
future required recreational space. Motion (Carter/2nd Love): amend to attach
revised written description dated 12.28.16; add a condition requiring the
applicant to apply to the City to close and abandon the existing northern
entrance road from the property to Chafee Road after the new southern
entrance road is completed and add a condition requiring a 100 foot buffer to
the rear of the lots to be shown on Exhibit 5, which may include stormwater
retention and landscaping uses – approved 5-0 Motion (Carter/2nd Love): recommend approval of
the rezoning as amended – approved 6-0. PH-Amend/Approve
