Bill Summary               

 

Deputy General Counsel Peggy Sidman explained the difference in the Council’s ability to impose requirements on speaking in the Public Comment period (completely voluntary; Council is offering the privilege of speaking to citizens and may impose time and manner restrictions) versus Public Hearings and Public Participation, which are mandated by state law and may not be subjected to conditions. Various options for identifying a citizen’s place of residence in a less explicit manner (i.e. by zip code, Council district or street name without a house number) were discussed. Ethics Officer Carla Miller reported that the Ethics Commission sees a “chilling effect” from the requirement to audibly state a specific home address in a public meeting broadcast over television and the internet, particularly for women and children and especially in the context of especially controversial issues where there may be a potential for retaliation against a speaker. Several council members suggested that technology might be used to display the addresses on the written speaker cards to the council members without displaying them to the public, thus eliminating the need for the address to be given audibly.

After a lengthy discussion about the requirement to disclose one’s address during public comment and public hearings, this bill was deferred at the request of CM Becton until the language can be clarified.

 CM R. Brown presented his reasoning for this moratorium on street closures for block parties: the need to reformulate the permit process to ensure public safety. CM Wilson asked if those who already hold permits will be grandfathered in or if they will have to cancel their events. OGC will look into the answer. CM Becton expressed his concern that in putting a moratorium on all permits, the ‘good’ are being punished for the behavior of a few ‘bad apples’. Mr. Brown said that his intent is to improve an ineffective ordinance quickly, in collaboration with JSO, to find a good permit process that is good for the whole city.
