School Board Member Scott Shine and Deputy General Counsel Peggy Sidman explained the history of the tie vote rule in question, which originally applied only to Orange County when enacted in the 1990s. That county has since grown out of the population range (800,000 to 900,000) in which the rule applies and Jacksonville has grown into the range and thus become subject to its application. In response to a question Mr. Shine indicated that the tie-breaking mechanism has been utilized once or twice in Jacksonville since the county became subject to the law following the 2010 Census. Council Member Crescimbeni questioned the constitutionality (one person, one vote equal protection implications) of allowing a school board chair to effectively have 2 votes.

Bill Summary     

 

Council President Boyer moved an amendment to add several additional zones in the San Marco Zoning Overlay area along San Marco Boulevard, Hendricks Avenue and Atlantic Boulevard to the resolution.  Deputy General Counsel Peggy Sidman explained the J-bill process at the state and local levels and gave a brief history of special zones in Jacksonville with differing alcoholic beverage licensing requirements.

 

Public Comment

Steve Diebenow representing Legacy Restaurants, the originator of the request for the J-bill, spoke in favor of the resolution and said that the Springfield Preservation and Restoration (SPAR) and Murray Hill Preservation organizations are in support of the designation of additional zones.
