·         Implements a 12% franchise fee for haulers of construction and demolition (C & D) debris

·         Removes the payment of the host fee for franchise haulers ($7.16/ton)

·         Self-haulers are exempt from franchise fee, but will still be responsible for the host fee

·         Requires future Council approval of form agreement to be administered by Public Works

·         Institutes a Class F offense ($500) for operating without a franchise

·         Exempts waste collected in Beaches and Baldwin from requiring franchise

 

RECOMMENDED AMENDMENTS

·         Insert necessary parentheses and punctuation, and correct spelling in various places

·         Amend the definition of the landfill closure program. Currently states that it is responsible for the closing of open but filled sanitary landfills, but it also is responsible for the maintenance of closed landfills.

·         Amend definition of gross receipts to clarify it applies to C&D collection, removal and disposal

·         Remove the percent radius amounts for use of mitigation funds.

·         Require landfill mitigation funds to be spent in a certain mile radius (both Class I and C &D).

·         Require Council approval to lower the franchise fee.

·         Mirror language in Commercial Franchise for Designated Place of Business definition.

·         Set the effective date for all franchises to begin on 10/1/18 or the date approved thereafter

·         Attach form franchise agreement and adjust language in the bill accordingly
