Though the Committee ultimately did not take up the bill as an emergency, a fairly lengthy discussion ensured prior to the deferral.

 

Council Member John Crescimbeni wanted to know what the nature of the emergency was.

Phillip Peterson, Council Auditor’s Office, noted that the wording in the actual ordinance, the nature of the emergency is that hurricane damaged structures needed to be repaired at the earliest opportunity and that the legislation would incentivize property owners to hasten repairs.

 

Tom Goldsbury, Chief, Building Inspection Division, fielded numerous questions on the costs of building permits and the timeframe in acquiring permits.

 

Council Member Lori Boyer was concerned about the legislation as crafted.  She cited what she characterized as flaws.  She felt that if enacted, the legislation would exclude property owners who had already contracted for roof and other repairs.  If the legislation is enacted, she would like to see that those property owners who have already contracted for repairs receive retroactive permit reimbursements and that the reimbursements not go to insurers or contractors.

 

Council Member Jim Love felt that the legislation should address roofing repairs solely.

 

Council Member Aaron Bowman asked Mr. Goldsbury if it were possible to determine whether people had roof damage caused by the hurricane or just wanted a new roof.  Mr. Goldsbury replied that it was not possible to make that determination.

 

Council Member Garrett Dennis explained why he felt that the permit fee waivers were necessary and the right thing to do.  He noted how many other counties and cities throughout the state had waived permit fees (see attachment that Mr. Dennis had distributed).  He explained that since he wanted the best possible ordinance, he was more than willing to defer the measure, host a noticed meeting, and discuss with other parties on how best to improve the proposed legislation.  The Chair announced that the ordinance was being deferred.
