There was a lengthy discussion of this item before the Chair deferred it, at the suggestion of Council Member Greg Anderson.

 

Barry Dixon explained his reasons for opposing the settlement agreement.

 

Charles Dixon III clarified his family’s opposition to the settlement agreement that he had explained at the previous TEU Committee meeting.

 

Attorney Reece Henderson, whose firm Gray Robinson represents Fannie Mae, contended that his client met all of the requirements for the waiver that the City had denied.  He also explained that the Dixons did not want to attend the mediation meeting but did participate in the proceedings of the Special Magistrate.

 

Attorney Paul Harden, representing the Dixon family, requested that the Committee vote to oppose the settlement agreement.  He further contended that the title company owns the parcel in question.  The City’s position is that according to public records, Fannie Mae is the owner of the property.

 

Assistant General Counsel Paige Johnston explained why the Office of General Counsel recommends approval of the settlement agreement.

 

After getting a sense from the other members on the panel, the Chair deferred the item.

In Public Comments, Mr. Anthony Holmes explained a concern that he had previously raised with the City regarding CSX train tracks in his Westside neighborhood.  Mr. Holmes contends that the CSX railroad tracks on Buckman Street are in such poor shape that a derailment is likely at some point.  He further explained that a derailment would be disastrous to the homes in the area because the tanker cars carry hazardous materials and would result in a life-threatening chemical spill.

 

Mr. Holmes also explained a concern about a waterline problem in Wigmar Park. 

 

The Chair assured Mr. Holmes that he would contract CSX to see if they are aware of the problem that he has referenced.  The Chair suggested that Mr. Holmes could meet with JEA staff that are in attendance at the meeting to discuss the waterline problem.

 

Mr. Michael Jasper explained his complaint with the Public Works Department for the department’s dumping dirt from an easement on his property when the department periodically comes to clean the easement. The department’s process of cleaning the easement is wreaking havoc to his trying to eke out a living from his gardening and chicken coops.  Council Member Reggie Brown explained that he and representatives of the Public Works Department have repeatedly met with Mr. Jasper in efforts to resolve the problems.  Mr. Brown explained that resolution of the problem is hampered by Mr. Jasper’s refusal to allow the Public Works Department access to his property.  The Council Member said that the City would continue to work with Mr. Jasper.
