Recently retired City Finance Director Mike Weinstein described the key elements of the collective bargaining agreements addressed in 2018-755, -756 and -757 below, including the provision that would allow the police and fire union employees to withdraw from the City’s employee health insurance plan and establish their own plan. That feature would not take effect until 2020 and the unions have agreed to keep Florida Blue as the administrator for their new program through 2022 so that there will be no negative impact on the premiums for the remaining City employees. Mr. Weinstein reviewed the Council Auditor’s list of issues/concerns. The unions have agreed to allow auditing rights by the Council Auditor’s Office and to give the Finance Department advance notice of any substantial change in their plans. The unions have agreed that they will bear any future costs associated with a one-time option for retirees who are not currently participating in the health insurance plan who opt to re-join the plan. In response to a question from Council Member Boyer, Mr. Weinstein said that the unions would have the right to establish and distribute the costs of participation in the plan among its participants provided that it doesn’t affect the City’s costs in any way. Assistant Council Auditor Kim Taylor cautioned that the option to rejoin the plan may change employee/retiree behavior.

 

Mr. Weinstein said that the health care reserve account is in good shape, and the City’s state-mandated reserve requirements will be reduced with a reduction in the size of the covered population. The unions will not reap any of the benefit of the reserves they have helped to create, and they will fund creation of their own required reserve accounts. He stressed that any unforeseen consequences or impacts can be dealt with in future collective bargaining processes, which happen every few years. The City administration offered to consider ways to make the police and fire health plans different than the other City employees within the context of the current plan but the unions were adamant about wanting to have a separate plan, as other police and fire departments around the country do.

 

Ms. Taylor said that having two health care plans will necessarily be more expensive than one plan, so costs will increase overall. She reiterated that the unions have complete control of the design and costs of their plan, so the City’s influence will only be via the collective bargaining process several years down the line after costs are incurred. She noted that the proposed use of reserve funds to pay for transition costs to current non-public safety employees would be a use of one-time funds for continuing costs. In response to a question, Mr. Weinstein said that the 2.5% wage increases for corrections employees is in addition to the raises approved as part of the pension reform plan 2 years ago. He said that the small size of the raises will have no impact on the City’s pension actuarial calculations.

 

Randy Wyse of the Jacksonville Association of Firefighters and Steve Zona of the Fraternal Order of Police both indicated their agreement with the proposed legislation and the discussion just had by the committee, Auditor’s Office and Mr. Weinstein. Council Member Gulliford praised the new cooperative spirit prevailing between the City and the public safety unions.

Council Member Crescimbeni explained the background of the lawsuit that led to the creation of the Tree Commission to help organize and expedite the use of the two tree protection trust funds for legitimate purposes, and described how the funds would be used to remove dead or dying trees and to plant new trees. Citizens would be able to request the planting of 1 or 2 trees in the public right-of-way abutting their properties.

Council Member Newby said this appropriation was requested by the Moncrief Beautification Committee for a road study. Ms. Boyer expressed support for the study but concern about the use of fair share fund interest earnings for this purpose. There are 2 types of fair share funds (geographic funds and project-specific funds) and this appropriation proposes to utilize interest earnings that derive from areas outside of the sector where this project would be conducted and therefore not permissible. She recommended finding another funding source. CAO Sam Mousa said that he would be happy to work with Mr. Newby and Ms. Boyer to identify an appropriate source for a floor amendment of the bill next Tuesday. Council Member Gaffney asked to be added as a co-sponsor of the bill.

Council President Bowman said that many activities are ongoing regarding the Council’s 1, 3 and 5-year budget priorities. He has talked to the administration about providing resources to the Task Force on Crime and Safety to accomplish its mission; no action needs to be taken today, but consideration needs to be given to how much and when to invest resources to get the job done. Council Member Boyer said that coordination and consolidation of the many disparate efforts is needed – the Mayor funds his priorities through his budget, the Sheriff funds his priorities through JSO-specific funds, and adding another layer of City Council-specific appropriations to another set of projects just adds to the confusion and inefficiency. Unity is what’s needed.

 

Damian Cook of the Office of Grant and Contract Compliance explained that a grant steering committee is required by the conditions of the grant to be appointed to determine how these funds should be spent. The steering committee’s work should dovetail nicely with the Council’s new Task Force. Jordan Elsbury of the Mayor’s Office said that the Mayor is committed to a coordinated effort of the two entities. Ms. Boyer said that the ultimate power to enforce coordination is the Council’s power to vote for or against any specific appropriations of funds.

The developer has done previous work downtown and is committee to development of this block, so non-completion should not be a problem. Leases have been negotiated for the three retail spaces pending Council approval of the ordinance. He confirmed that the City funding is going to the parking lot aspect of the project. Kim Taylor said that the development agreement references 35, not 50 parking spaces. Guy Parola of the DIA said that the agreement references 35 spaces because more would cause a sidewalk to have to be removed, which the agency does not want to do. Mr. Duggan said that the developer can accept either parking lot size – the decision lies with the City.

Overall Concerns:

  1. Deconsolidation – The option for IAFF and FOP members to split from the City’s healthcare plan further chips away at and reduces the benefits of consolidated government. Different healthcare plan rates and benefits for these employees could be negotiated by the City while these employees remain a part of the City’s healthcare plan rather than allowing them to form a separate plan.
  2. Loss of Control – The City will have little to no control or oversight over the new healthcare plans for FOP and IAFF members except during collective bargaining. The City will be responsible for paying its portion (58.8%) of healthcare costs for FOP and IAFF Members even though the City and City Council will have no involvement in decision making regarding the benefits to be provided to these employees. Enriched plans could result in significantly higher costs for the City. 
  3. Impact to City/Other City employees – Assuming the separate plans occur, the City’s actuary projects that in calendar year 2020, the current healthcare plan costs for all other City employees/retirees will be $15.6 million (or 40.3%) more than what will be paid in by the City and other City employees/retirees. If these additional costs are covered through the use of the healthcare reserves, this would significantly reduce the reserve balance. Most importantly, the use of one-time reserves for recurring costs does nothing to address the problem that rates paid by the other City employees/retirees would be significantly out of synch with the actual costs and therefore, would necessitate significant future increases. For calendar year 2021, using the actuary’s assumption that there will be an 8% increase in claims, without any rate increase, this would mean that the healthcare plan costs for all other City employees/retirees would be $19.8 million (or 51.3%) more than what would be paid in by the City and other City employees/retirees. 
  4. Self Insured vs. Fully Insured – Given the unknowns surrounding these plans, if the FOP and IAFF decide to go self-insured, it is unknown how their initial reserves required by State Statute (60 days of average claims on hand) would be funded. The City could have to pay 58.8% of the costs if built into the premium.

5.     Impact from Retirees – Currently the City contributes nothing toward retirees’ healthcare costs and retirees are not allowed to rejoin the City’s healthcare plan once they leave the plan. If retirees have the ability to rejoin the proposed new plan, this would significantly increase the City’s costs because the City has agreed to pay 58.8% of the total cost of the plan. (For example, if the cost of a retiree’s plan is $10,000 and the retiree rejoins under the proposed plan, the City would now be required to contribute an additional $5,880 to the plan versus $0 under the current structure.)

6.     Access/Audit/Investigative Rights – We are awaiting confirmation on whether the Council Auditor’s Office and the Office of Inspector General will have the same audit/investigative rights that we have related to the current plan. Also, we have asked what the City will be able to access and review as part of normal day-to-day activity including such tasks as approving payments related to the new plans.

Summary:

The proposed bill will authorize a Redevelopment Agreement with 2018 Leila Jax, LLC (Developer), along with a Property Exchange Agreement and other related documents. Pursuant to the terms of the Redevelopment Agreement and the Property Exchange Agreement, the Developer proposes to convey a 0.53 acre parcel, with an estimated value of $896,237, to the City in exchange for the City to convey a 0.63 parcel, with an estimated value of $680,000, to the Developer. The City parcel to be conveyed consists of a portion of May St. and the “jug handle” located on the corner of Leila St. and Riverside Ave. The City will also contribute the necessary credit acres of Water Quality Compensatory Credits for all the improvements with an estimated value of $108,000.

 

After the property exchange, the Developer intends to develop approximately 15,000 square feet of retail improvements and a surface parking lot to support the retail improvements, with an estimated Capital Investment of $6 Million. The Developer will also construct a public use surface parking lot (Surface Parking Lot) on the parcels conveyed to the City, with an estimated cost of $154,933 and will make road repairs to Leila St. adjacent to the project parcel, with an estimated cost of $173,388.

 

Upon substantial completion of the Surface Parking Lot, the DIA will make an up to $99,500 contribution to the Developer as a reimbursement of costs for the design and construction of the Surface Parking Lot. All cost overruns will be the responsibility of the Developer.

 

The total estimated City investment for this project will be $887,500. This consists of the land conveyed to the Developer, Water Quality Compensatory Credits and the contribution for the City Parking Lot.

 

Once the City conveys the property it owns to the Developer, the City has no further recourse with the Developer if the retail improvements are not constructed. However, this property would be on the tax rolls and there will be performance bonds or a letter of credit to ensure completion of the Surface Parking Lot and Leila St. Improvements.
