Different healthcare plan rates and benefits for these employees could be negotiated by the City while these employees remain a part of the City’s healthcare plan rather than allowing them to form a separate plan.

2.      Loss of Control – The City will have little to no control or oversight over the new healthcare plans for FOP and IAFF members except during collective bargaining. The City will be responsible for paying its portion (58.8%) of healthcare costs for FOP and IAFF Members even though the City and City Council will have no involvement in decision making regarding the benefits to be provided to these employees. Enriched plans could result in significantly higher costs for the City. 

3.      Impact to City/Other City employees – Assuming the separate plans occur, the City’s actuary projects that in calendar year 2020, the current healthcare plan costs for all other City employees/retirees will be $15.6 million (or 40.3%) more than what will be paid in by the City and other City employees/retirees. If these additional costs are covered through the use of the healthcare reserves, this would significantly reduce the reserve balance. Most importantly, the use of one-time reserves for recurring costs does nothing to address the problem that rates paid by the other City employees/retirees would be significantly out of synch with the actual costs and therefore, would necessitate significant future increases. For calendar year 2021, using the actuary’s assumption that there will be an 8% increase in claims, without any rate increase, this would mean that the healthcare plan costs for all other City employees/retirees would be $19.8 million (or 51.3%) more than what would be paid in by the City and other City employees/retirees. 

4.      Self Insured vs. Fully Insured – Given the unknowns surrounding these plans, if the FOP and IAFF decide to go self-insured, it is unknown how their initial reserves required by State Statute (60 days of average claims on hand) would be funded. The City could have to pay 58.8% of the costs if built into the premium.

5.       Impact from Retirees – Currently the City contributes nothing toward retirees’ healthcare costs and retirees are not allowed to rejoin the City’s healthcare plan once they leave the plan. If retirees have the ability to rejoin the proposed new plan, this would significantly increase the City’s costs because the City has agreed to pay 58.8% of the total cost of the plan. (For example, if the cost of a retiree’s plan is $10,000 and the retiree rejoins under the proposed plan, the City would now be required to contribute an additional $5,880 to the plan versus $0 under the current structure.)

6.       Access/Audit/Investigative Rights – We are awaiting confirmation on whether the Council Auditor’s Office and the Office of Inspector General will have the same audit/investigative rights that we have related to the current plan. Also, we have asked what the City will be able to access and review as part of normal day-to-day activity including such tasks as approving payments related to the new plans.

Summary:

The proposed bill will authorize a Redevelopment Agreement with 2018 Leila Jax, LLC (Developer), along with a Property Exchange Agreement and other related documents. Pursuant to the terms of the Redevelopment Agreement and the Property Exchange Agreement, the Developer proposes to convey a 0.53 acre parcel, with an estimated value of $896,237, to the City in exchange for the City to convey a 0.63 parcel, with an estimated value of $680,000, to the Developer. The City parcel to be conveyed consists of a portion of May St. and the “jug handle” located on the corner of Leila St. and Riverside Ave. The City will also contribute the necessary credit acres of Water Quality Compensatory Credits for all the improvements with an estimated value of $108,000.

 

After the property exchange, the Developer intends to develop approximately 15,000 square feet of retail improvements and a surface parking lot to support the retail improvements, with an estimated Capital Investment of $6 Million. The Developer will also construct a public use surface parking lot (Surface Parking Lot) on the parcels conveyed to the City, with an estimated cost of $154,933 and will make road repairs to Leila St. adjacent to the project parcel, with an estimated cost of $173,388.

 

Upon substantial completion of the Surface Parking Lot, the DIA will make an up to $99,500 contribution to the Developer as a reimbursement of costs for the design and construction of the Surface Parking Lot. All cost overruns will be the responsibility of the Developer.

 

The total estimated City investment for this project will be $887,500. This consists of the land conveyed to the Developer, Water Quality Compensatory Credits and the contribution for the City Parking Lot.

 

Once the City conveys the property it owns to the Developer, the City has no further recourse with the Developer if the retail improvements are not constructed. However, this property would be on the tax rolls and there will be performance bonds or a letter of credit to ensure completion of the Surface Parking Lot and Leila St. Improvements.

 

Amendment:

Place a revised Agreement On File to:

a.       Reference the Surface Parking Lot in Section 2.7

b.      Remove the reference of Leila St. Improvements in Article 5 and clarify in Article 6 that performance bonds are a requirement for the Leila St. Improvements

c.       Correct section reference in Section 5.6

d.      Correct scriveners error in Section 7.1

e.       In Section 10.1 change “Leila St. Improvements” to “Surface Parking Lot”

f.       Correct DIA Suite number in Section 11.2

g.       Update Exhibit I to remove reference to Historic Preservation Section
