Council Auditor Kyle Billy reviewed the reports listed above. The Sheriff’s Investigative Fund Reports (#816, 817 and 818) for the 3 fiscal years found that the funds were being spent and accounted for properly. There were a few recommendations for operational improvements, the implementation of which will be reviewed in next year’s report on the fund. #819 is a summary of the FY18-19 budget review and adoption process. #820 describes the Council Auditor’s workload and projects during FY17-18.  #770A is a follow-up to the previous audit of JFRD’s payroll. The follow-up found that 16 of 21 issues have been resolved; the 5 remaining issues will be reviewed again in a future follow-up.

Council Member Crescimbeni distributed information about previous voter referenda and the recent straw ballot question about citizen approval of the terms and conditions of a sale of more than 10% of the assets of the JEA, and distributed a General Counsel’s opinion regarding the procedure for a sale of substantial JEA assets. Council Member Gulliford proposed an amendment regarding the timing of a voter referendum (within 6 months of a sale agreement being struck between the seller and buyer). He anticipates that City Council would withhold a vote on approving a sale until within 6 months of an election at which the referendum could be held.

 

Motion (Gulliford): amend the bill to require that the referendum be held within 6 months of the City Council approving the terms and conditions of a sale

 

Council Member Crescimbeni said that City Council already has the power to call for a referendum special election at any time, so the amendment is not needed. Council Member Boyer said that a City referendum requirement does not belong in the JEA Charter and suggested the need for better clarity of the language regarding timing of the referendum. Council Member Gulliford said that putting the referendum requirement in the Charter rather than the Ordinance Code prevents a future council from waiving the requirement.

 

Council Member Gulliford agreed to withdraw his motion and take up the issue in separate legislation.

 

In response to a question from Chairman Anderson about the definition of “assets” and how various interpretations could impact JEA’s normal operations, Jordan Pope of the JEA said that the authority believes that some clarification of the definition in the charter is needed in future legislation to draw a distinction between operational and capital assets.

Council Member Boyer discussed the insufficiency in the current waiver disclosure language that requires a notation in the bill title and requires a waiver paragraph in the text of the bill explaining what is being waived.

 

Motion (Boyer): insert additional language in the Explanation of Appropriation section and insert concrete waiver language in the bill conforming to the Code requirement – approved 7-0.

 

Stephanie Burch, Director of the Neighborhoods Department, explained the intent of the bill and the use of the funds for “soft costs” such as payment of back taxes, lien removal, quieting titles, etc. that typically cannot be paid by the City to make the properties readily usable for affordable housing development. Council Member Gulliford expressed concern about the “first come, first served” nature of the funding availability. He suggested the need for a permanent program to provide funding for the same purposes as the recently-expired lien penalty and interest amnesty program.

CAO Sam Mousa said that the bill is intended to help the Jacksonville Icemen achieve the return on investment that they expected when bringing the team to Jacksonville. The City’s return on investment on arena operations has been above projections, the Icemen’s ROI has been below projection. The surcharge reduction would reduce the Sports Complex capital maintenance fund revenue by $124,200, which will not impact the fund’s activities significantly. Council Member Crescimbeni speculated that other Arena tenants will soon be coming to ask for reductions as well. Council Member Boyer asked Mr. Mousa to look for other sources of funding to make the capital improvements that these de-appropriated funds would have paid for.

Council Member Gulliford asked Council Member Crescimbeni about the rationale in 2018-142 for the 10% of assets threshold to trigger a voter referendum on sale of JEA assets. Mr. Crescimbeni said that his original preference was to introduce legislation to hold a referendum to make any JEA sale transaction be subject to voter referendum approval, but a General Counsel’s opinion said that voters cannot grant themselves the right to hold referenda by means of a referendum. Failing that, he fell back to the existing Charter requirement that requires City Council approval of a sale of more than 10% of JEA assets and added his referendum requirement to that. He said that the OGC opinion says that a lease of the assets is equivalent to a sale for purposes of requiring City Council approval.

 

Chairman Anderson discussed the City Council’s former practice of developing annual budget priorities and sharing those with the mayor prior to the budget development process, a process that existed in the early 2000s but was repealed in 2007. Council President Bowman re-started this process this year with a City Council strategic planning process for 1, 3 and 5 year priorities and a plan to make recommendations to the Mayor for Council preferences for spending up to $5 million of discretionary funds. The Jacksonville Civic Council has offered to lend assistance in determining priorities if the City Council wishes. This process will need to happen quickly if the Finance Committee is to make recommendations to the full Council for adoption in February for transmittal to the Mayor’s Office in time to inform the budget development process.

 

Mr. Anderson distributed a handout consisting of the Council’s and Mayor’s adopted budget priorities from the early 2000s and a summary of Mayor Curry’s FY18-19 budget message outlining his priorities. He has a large number of documents and resources that he can make available to the committee depending on how the group wants to proceed.

 

Council Member Boyer suggested that “homelessness” is a very specific topic that needs to be incorporated into a broader heading (affordable housing?). She noted that in previous years the priority list included a category for natural resources, which could have several meanings. Council Member Gaffney said that prioritization will be important and recommended putting most resources into the top 2 or 3 issues rather than spreading funding too thinly over many issues. Council Member Morgan noted that the priorities identified this year are largely the same as those identified 15 years ago – crime and safety, litter control, beautification, park maintenance, etc. Nothing seems to have changed. Council Member Crescimbeni said that the Rules Committee and Finance Committee should work jointly on developing very specific priorities rather than general statements. Priorities need to be achievable in the short term and measurable so that success or progress can be readily determined.

 

Chairman Anderson hoped that the Finance Committee would agree to hold several special meetings to discuss budget priorities with participation by many interested council members. He has asked the Council Auditor’s Office to begin compiling spending information on several perennial topics (litter control, mowing, crime prevention). Council Member Newby suggested the importance of capital improvements in older neighborhoods in addition to purely operational issues. Council Member Love agreed that funding for signature projects (i.e. the Emerald Necklace, Shipyards, The Landing) is important and believes they have countywide impact. Council Member Wilson advocated for attacking the homelessness issue, both the voluntary and the involuntary homeless, and improving commercial corridors. Council Member Boyer said that the fact that the same issues keep cropping up year after year can be a good thing from the perspective that it shows continuing prioritization of a few issues of importance to the community. She advocated for separating operating budget enhancements from capital project discussions – those have to be funded differently and should be discussed separately. Council Member Gaffney said that choosing too many priorities leads to funding being spread thin and nothing substantial getting done.

 

Chairman Anderson asked for consensus on several top priorities – public safety was acknowledged as one important topic. He asked the committee to think about the various categories and submit suggestions and preferences for a revised listing to be discussed at a future meeting.
