Beth McCague representing the Port Authority said that the project is being paid from excess revenues above budget this year. Business is very good at the port, but maintenance dredging will be an on-going issue.

Council Member Boyer posed questions to attorney Wes Haber, representing the CDD, about maintenance of facilities constructed by the CDD – there seems to be contradictory language between the CDD petition and the rest of the agreement about who will be responsible – the City or the CDD. Vince Dunn, the civil engineer for the project, explained that the public roads will be dedicated to the City for maintenance and the CDD will provide an enhanced maintenance level, as is done in other CDDs in the City. Ms. Boyer advocated for clarity in the responsibilities of the parties. Susan Grandin of the General Counsel’s Office confirmed that the City would always inspect roadways to ensure that they are built to City standards before acceptance. Duane Kent, a project manager in the Public Works Department, explained the process for inspecting and accepting roads constructed by private developers. Council Member Boyer said that her primary concern is whether the facilities are open and accessible to the general public versus primarily serving just the residents of the neighborhood, which should determine who is responsible for the maintenance cost. She sees a growing trend in the use of CDDs to build infrastructure citywide to be later maintained by the City.

In response to a question from Council Member Boyer about whether consent of the property owners of both the property to be excluded and the other owners within the CDD has been obtained and whether that impacts on the amount each property owner will have to pay the CDD for its improvements, Mr. Haber said that some CDD improvements have been made, but the debt assessment on this subject property has been paid off so that it’s free to be excluded having paid its fair share of the costs. Mr. Haber explained why the parcel is being excluded; the new owner of the parcel (a developer) wants to pay for site improvements itself instead of the CDD doing the work. The committee felt that unanswered questions still remained.

In response to questions from Council Member Boyer, Daryl Joseph, Director of the Parks, Recreation and Community Services Department, said that the space will be both office space for the organization as well as prep space for events in the park. Council Member Boyer suggested the need to treat Ed Ball Building non-profit tenants equally and wondered how decisions are made about how vacant space in City buildings is assigned to potential users.

 

Renee Hunter, Real Estate Officer, described the proposed use of the space in the Ed Ball Building by Friends of Hemming Park. The organization will be using less space in Ed Ball than it is currently occupying in the Main Library. She said the only interest in the space, which used to be a restaurant, is by other restaurants operators, but the space does not have sufficient ventilation for a restaurant to operate properly, so the Real Estate Division has been looking for other potential types of tenants in order to get a user into the space.

In response to a question from Council Member Boyer, Jessica Shepler of the JTA said that the use of Park Street for the busway has been discussed with the Public Works Department regarding the City’s latest plans for the Park Street corridor. Ms. Boyer wanted to insert language in the bill requiring that improvements impacting Park Street must be consistent with the City’s CIP project and long range plans for Park Street. She knows that a 2-lane cycle track has been proposed for one side of the road and doesn’t want JTA’s improvements to negatively impact the City’s project.

Council Member Boyer said that the Council Rules describe how bills are introduced and where bills are assigned to committees, such as those involving Community Development Districts. The Council Rules provide that CDD bills are introduced by the TEU Committee and she wondered why proposed CDDs get an automatic right to introduction when many other bill types don’t have such a right. She suggested the need to examine automatic rights to introduction in the larger review of the Council Rules, including whether the approval of at least 1 council member should be required rather than an item being introduced automatically by a committee pursuant to rule.
