Presentation:

Carr, Riggs & Ingram – City’s Comprehensive Annual Financial Report for FYE 9/30/17

Council Auditor Kyle Billy explained that the firm is in the first year of a 2-year extension of its original 3-year contract. Robert Lemon of CRI distributed and discussed a Schedule of Findings and Questioned Costs for FY16-17. The City received an unmodified opinion (a clean audit, the highest level) on its financial statement as well as on its single audit (of federal and state grant funds), although the single audit found 2 significant deficiencies in the federal grant program and one material weakness (more substantial) in a state grant program. They related to listing and tracking of all federal and state grant expenditures. Council Member Boyer pointed out that the deficiencies and material weakness appeared to be in one-time grants, not the usual ongoing grants the City receives every year; Mr. Lemon agreed that that was the case. CFO Joey Greive said that steps are being taken to identify and capture all grants received by all departments, some of which fall under budget codes that are not the usual ones normally monitored by the Finance Department for grant activity. Ms. Boyer said that grant applications and administration has always struck her as a weakness in Jacksonville’s operations. There is a natural tension between trying to centralize grants administration in one office versus having grant functions in each department which have more subject matter expertise.

 

Mr. Lemon reviewed the required communications resulting from the audit and reported that there were no substantial issues and all of the financial statements were accurately presented. Yvonne Claiborne pf CRI said that the City has a great deal of institutional knowledge in its Finance Department and the City’s reports were well prepared and presented.

 

Kyle Billy briefly discussed two recently-released follow-up reports on the Duval County Property Appraiser Audit (#720B) and the Oceanfront Parks Revenue Audit (#721B). All remaining issues were cleared and all recommendations implemented in both audits so no further follow-up is necessary.

 

The committee was in recess from 9:58 to 10:18 to attend a ceremony in Hemming Park.

Bill Summary         

 

Council Member Crescimbeni reported that the Tree Commission has voted to not recommend use of Tree Trust Funds on Medjool date palms, which are expensive, are susceptible to a fungus, and make a mess with their dropped fruit. There is some evidence that salt air protects trees planted very close to the ocean from the fungus so they may be appropriate in oceanfront settings. He said that there are one or two other palm species that have a similar appearance to date palms that could be planted in their place. Mr. Crescimbeni noted that the City’s tree planting contract with Davy Tree Company has expired and is being re-bid, and prices for planting are almost certain to go up. Council Member Gulliford offered an amendment to establish a western boundary from the ocean within which Medjool date palms would be allowed to be planted using tree trust, citing Mayport Road and Penman Road as a possible compromise between State Road A1A/3rd Street and the Intracoastal Waterway.

 

City Arborist Kathy McGovern said that the Medjool date palms seem to do well in areas close to the ocean (salty air seems to combat the fungus) and asked for time to do further research about exactly where to draw a planting boundary line based on the fungus issue and survivability. Council Member Boyer will propose an additional amendment regarding the applicability of this restriction to previously-approved tree planting designs that incorporate Medjool date palms so that planting plans don’t need to be redrafted. Ms. McGovern will do further research on the range of the fungus and will return with a proposed boundary line.

 

Council Member Crescimbeni reported that the Tree Commission has produced an application process and scoring mechanism for tree planting grants on public property that can be processed fairly easily and quickly and offered to have commission staff come to council member town hall meetings to discuss planting ideas. Davy Tree Company’s decision to decline to renew its contract with the City has thrown a wrench in the works and complicated the process. Mr. Crescimbeni said that he will be introducing legislation to appropriate funds out of both of the tree protection trust funds to expenditure accounts to let Public Works tackle numerous needed  tree replacements and to allow applications for use by interested volunteer and community groups.

In response to a question from Council Member Boyer, Council Member Gaffney described the church’s intended use of the property, which includes land-banking for future use, possibly including affordable housing. Renee Hunter, Real Estate Officer, said that she did not know of any restrictions imposed on the property after its transfer. Deputy General Counsel confirmed that statement and said that there is no reverter clause included. Ms. Boyer suggested the need for a deferral and development of future use conditions and a reverter clause. Council Member Gaffney offered to propose an amendment to prohibit future sale of the property but opposed a time limit on when a reverter clause would take effect. The OGC was instructed not to draft and file the previously approved amendment.
