Development Taxes Audit
Mr.
Billy noted that the Ordinance Code does not give the Council Auditor’s Office
audit rights on collection of these funds; that audit authority lies with the
Finance and Administration Department. The audit identified excessive computer
access rights among employees and a software calculation error in cases where a
payment was submitted to the Tax Collector both lat and in an incorrect amount.
The audit recommended that the Finance Department initiate audits of TDC tax
collections and that the Council Auditor’s Office be given audit rights via
amendment of the Ordinance Code. The audit also noted that the City is not
collecting bed taxes from “peer-to-peer” rentals (i.e. Airbnb). Thirty-seven
Florida counties have agreements with Airbnb to have those taxes remitted, but
Jacksonville is not one of them. The policy of whether to collect taxes on
peer-to-peer rentals has Zoning Code implications. Council Member Boyer noted
that the Tax Collector’s Office keeps half a percent of the various taxes and
fees it collects as an administration fee. She also briefly reviewed some of
the policy issues that were under discussion at a statewide level on the
subject of these types of rentals. Deputy General Counsel Peggy Sidman said she
understood that the Council President might be thinking exploring potential
solutions to this issue. Chairman Anderson asked for this issue to be on the
Finance Committee’s next agenda for a follow-up. Chief Administrative Officer
Sam Mousa said that the Zoning Code issues are important and a complicating
factor in whether or not to collect the TDC tax. Council Member Gulliford
requested that Council Research investigate how other counties handle the
zoning issues related to peer-to-peer rentals.

of a standard agreement form that might be used to grant free parking in
other City garages, some of which (the MPS-managed garages) incur City
financial obligations. Chief of Public Parking Bob Carle explained that this
bill only applies to the parking facilities covered by the Parking Enterprise
Fund, which does not include the MPS garages. CFO Mike Weinstein reported
that MPS owns its garages which are on City land. Ms. Boyer recommended the
insertion of language to specifically exclude the MPS garages for purpose of
clarity. The bill was tabled to give staff time to craft an
appropriate amendment When the bill was removed from the table later in the
meeting, Peggy Sidman explained the proposed amendment in the bill and form
of contract to make it apply only to City-owned parking facilities as listed
in Sec. 122.201, Ordinance Code. Council Members Boyer and Gulliford
expressed concern about potentially delegating to the administration an
open-ended authorization to enter into free parking agreements in the future.
Ms. Boyer recommended adding a maximum limit of 50 free spaces to event

Billy and Mike Weinstein explained the reserve funds being accumulated for
payment of the salary increases collectively bargained as part of the pension
reform package 2 years ago. Mr. Weinstein explained that the reserves for
General Fund agencies are being handled through a centralized fund while the
reserves for enterprise fund agencies are held in their budgets as designated pension
reserve contingency funds.
Property Appraiser Jerry Holland asked that his office be
kept in the loop on the tourist development tax discussion from earlier in the
meeting because rental of a portion of a home for more than 30 days in 2
consecutive years makes the portion of the property being rented ineligible for
the homestead exemption.
Motion: approve the Council Auditor’s
recommendation to increase the Furniture and Fixtures budget from -$5,000 to $0
to correct an erroneous entry – approved

Motion: tentatively approve the Property
Appraiser’s budget as amended – approved
