#811- Mobility Fees Audit

Findings include excessive computer access rights (a common finding in many audits); incorrect calculations of fees in a few instances (City owes $70,446.91 to developers); excessive waivers of fees pending Certificates of Occupancy (City owed $53,546); Concurrency Office charging incorrect amount for extension fees; Concurrency Office not following all of the City’s standard operating procedures on cash handling.

 

Ms. Boyer said that she recognizes the need for a legislative fix to the problem of incorrect extension fees and she will have a bill drafted by August.

 

#812- Landfill Contract Audit

Overall payments are consistent with the contract and properly supported and authorized. Several issues were identified: monthly tonnage payments were not reviewed by a supervisor; payments to a contractor were not always processed in a timely manner; all 18 of the monthly tonnage payments were inaccurate, but to a very small degree in total; one hauling company was not billed by the Solid Waste Division for $9,331.36; excessive computer access rights; insurance documentation was not provided and therefore not approved by the Risk Management Division.

Assistant Council Auditor Kim Taylor reviewed the proposed amendments. Risk Manager Twane Duckworth agreed with the amendments. In response to a question from Council Member Morgan, Mr. Duckworth explained the need for an operating reserve to prevent the need for the General Fund to offset deficits that might occur in the future as has been done in the past. In response to a question from Chairman Anderson, Mr. Duckworth explained the need to increase the claims thresholds to match state law increases and said that any settlements over those thresholds require approval from the Florida Legislature.

Summary of changes to Ch. 128:

·         Discontinues the practice of pooling claims among participants

·         Establishes a Joint Operating Reserve funded by and available to all participants- fiscal impact to FY 2018/19 budget is $1.85 million

·         Establishes minimum Retained Earnings threshold of 10% for each participant

·         Establishes language in the Ordinance Code stating that Risk Management review insurance and indemnity provisions (for example in contracts, agreements, legislation, etc.)

Council Member Gulliford said that he believes the city’s greatest returns from economic development projects come from capital investment that produces direct tax revenues; employment growth produces indirect impacts that are shared with other counties where employees may choose to live and shop. Mr. Wendland emphasized that the OED generally brings the Council deals in which the City is well protected financially. In response to a question from Chairman Anderson, Bob Carle of the Office of Public Parking said that the Yates Building has adequate capacity to provide these spaces, which will bring typical daily occupancy to about 80%

Chairman Anderson reviewed the upcoming budget hearing schedule for the FY18-19 budget. The Mayor will present his budget message on July 23rd, immediately followed by a special Finance Committee meeting to approve the tentative millage rate for transmittal to the state by the August 4 deadline.  The Property Appraiser’s budget will be taken up in a regular Finance Committee meeting on August 7th for transmittal to the state by the required deadline. Mr. Anderson said that if the committee gets ahead of schedule along the way, departments may be moved up to an earlier meeting to potentially shorten the process by the end.
