Council Auditor Kyle Billy to discuss Report:

#765A: Supervisor of Elections Follow-up Report

Mr. Billy said that the original audit covered elections held in 2014 and reviewed payments to poll workers and for polling places. Eight issues were identified in the original report; 4 have been cleared and 4 remain unresolved. The unresolved issues include: 1) control weakness with payment review and approval process; 2) inadequate access rights to the election worker payroll system; 3) lack of proper authorization and inconsistent recording of time; and 4) opportunity for improvement for automated process for calculating hourly pay for early voting workers. The Supervisor of Elections has agreed to make changes and improvements to address the outstanding issues. In response to a question from Council Member Boyer about the seriousness of the issues and the potential need for any Council action, Mr. Billy said that it appears that the issues are being addressed appropriately by the Supervisor of Elections and, presuming that continues, there is no need for Council action. His office will issue another follow-up report in 12-18 months to measure progress toward completion.

Council Member Boyer asked about a continuing Florida Communities Trust obligation of $90,000 for a project at Palmetto Leaves Park which requires the use of these funds; she wants to be sure the obligation is covered before these funds are divided among the 14 district funds. Parks and Recreation Department Director Daryl Joseph explained the FCT obligation.

 

Amendment (Schellenberg): Deduct $90,000 for the Palmetto Leaves Park project and divide the remainder among the 14 districts.

Amendment to the amendment (Boyer): the disbursements to the council districts will be in equal amounts and the BT will be amended to reflect that.

The amendment as amended was approved.

 

In response to a question from Chairman Dennis, Kim Taylor said that she recalled several bills that have distributed funds from this account equally among all council districts. Council Member Boyer explained the original intent of the Loblolly Mitigation Fund and the need to meet various obligations resulting from state participation in certain projects before the remaining funds can be distributed to the council districts for other purposes. Kim Taylor reported that 9 of the 14 districts have not expended any of the previously-appropriated Loblolly funds, 3 have partially expended the funds and 2 have completely expended those funds. Council Member Schellenberg explained how he identified the Loblolly Fund as a funding source and his intention to incentivize council members to identify projects and get them underway immediately. Mr. Joseph stated that the funds are intended to be used for capital improvement purposes. Council Member Gaffney questioned how the use of these funds is balanced against distribution of park funding in the annual budget.

·         Abyssinia Missionary Baptist Church applied for and was awarded a Public Service Grant (PSG) totaling $58,724 in the FY 2006/07 with Apel Health Services Center, Inc. listed as the program name.

 

·         The PSG agreement was executed between the City and “Apel Health Services Center, Inc.” and payments were made to Apel totaling $58,724.

 

·         A second contract was executed between the City and Apel Health Services Center, Inc. for a faith-based grant in the amount of $10,000.

 

·         No audit was received from either Abyssinia Missionary Baptist Church or Apel Health Ministries for the two grants mentioned above.

 

·         Abyssinia Missionary Baptist Church was placed on the non-compliance list because that was the organization listed as the PSG recipient in the Budget Ordinance.

 

·         Federal 990 Forms for Apel Health Services Center, Inc. show no revenue being received from the City of Jacksonville or any other sources for years 2006 and 2007.

 

 

In response to a question from Council Member K. Brown, Deputy General Counsel Lawsikia Hodges described the payment schedule and obligations in the two contracts and whether receipts were required before payments or not. Councilwoman Brown said that neither the City nor the church’s bank keep records from that period any longer so there is no way to prove that the payments were properly made, despite the fact that the City would not have made the payments without having receipts for reimbursement of at least three-fourths of the payments. Council Member Boyer advocated that a process be developed to save the records relating to any organization on the Council Auditor’s non-compliance list and to review those records before their destruction under the state’s records retention and destruction regulations so this situation does not reoccur. In response to a question from Council Member R. Brown, Ms. Hodges said that the City’s grants office has thought about these issues and that the Office of General Counsel stands ready to assist in the process. Councilman Brown said that he would call a noticed meeting to start the process of drafting legislation to establish such a process. Council Member Schellenberg said this incident is representative of a larger theme of non-compliance on the part of recipients of City grants and economic development incentives, which he believes needs to be addressed.

In response to a question from Council Member Becton, Property Appraiser Jerry Holland explained that the salary increases in his budget match the increases awarded by the City to its employees as a result of the pension reform package approved 2 years ago.

 

In response to a question from Council Member K. Brown, Mr. Holland explained the process for assessing properties that are damaged or destroyed, and said that state law requires that the Property Appraiser must physically inspect each property once every 5 years. Appeals of valuations from previous years must follow state law and must be made before the close of the Value Adjustment Board appeal process each year.
