Recapture Memo – Kyle Billy, Council Auditor

Council Auditor Kyle Billy distributed and discussed a memorandum on the recapture of FY16-17 year end fund balances from accounts that received a General Fund subsidy. The total recapture amount is $5,493,756, largely recaptured from the Public Building Allocations ($2.4 million) and City Venues – City ($1.3 million). He noted that the Huguenot Park subfund 1D1 ended the year in a negative cash position

 

Motion (Schellenberg/2nd Gaffney): the Finance Committee authorizes the Council Auditor to draft a Budget Transfer and the Office of General Counsel to draft an ordinance to transfer funds from fund balance to cover the negative cash balance in the Huguenot Park subfund.- approved 6-0.

 

Mr. Billy explained the automatic recapture procedure set forth in the Ordinance Code.

She said that the helicopter will be used about 8 times per month (96 times per year). Council Member Schellenberg asked for information on the annual cost of helicopter operation. Council Members Boyer and Becton thanked Ms. Burch for the very fine white paper she prepared that explained all the factors involved in the purchase decision.

Brian Key of the JSO said that Shot Spotter has been in operation since July of 2017 and is showing initial success. Response time is reduced and is automatic instead of waiting for a phone call, and recovery of shell casings is improved because of the triangulation of the exact location of shots. Council Member Boyer posed a question about whether this grant includes funds for reimbursement of the City’s purchase of the equipment last year. Kim Taylor said that the grant will be reimbursing previous City capital spending and will free up those capital funds for other uses. Teresa Eichner of the Finance and Administration Department explained the process of returning these recouped funds to the district bond funds of the council members who contributed to the original purchase.

Council Member Boyer talked about the allowable uses of the fund which include security cameras for private businesses, which she has never seen the City do. She believes the Trust Fund is currently being used as a sort of Public Service Grant program within the JSO to be used at the Sheriff’s discretion. Undersheriff Pat Ivey said that the JSO is considering various types of security camera installations and is preparing to launch a pilot program for cameras in parks, but not using this source for funding. Council Member Reggie Brown said that cameras are also needed in known trash dumping sites to catch offenders who contribute to community blight. Undersheriff Ivey said that cameras won’t work in all situations, particularly where the dump sites are far removed from power sources to run the cameras. JSO Budget Officer Bill Clement said that inmate cleanup crews are being organized to help with cleanup efforts, but this trust fund cannot be used for operational expenses. Council Member Boyer asked the Undersheriff to provide additional information to the Clean and Safe Neighborhoods Committee about dumping sites, enforcement efforts and camera assistance possibilities. Mr. Clement explained the allocation of administrative funds as required by state law to pay expenses of processing forfeitures. Council Member Boyer said that the state statute has various categories of eligible expenditures and that the City Council has a role to play in establishing priorities. Peggy Sidman read from the statute a provision that expenditures are initiated by request for appropriation by the Sheriff for one of the eligible uses and subsequent approval by the governing body.

Council Member Boyer explained Council Member Crescimbeni’s stated rationale for holding a straw ballot on the JEA issue, regardless of whatever action may be taken by the JEA and City Council, as a means of judging the community’s sentiment and perhaps encouraging future councils to conform themselves to the public’s position and not consider reversing course at a future date. Council Member Katrina Brown felt that the straw ballot would be more informative if it gave the voters a means of expressing their preferences for how the proceeds of a potential sale should be used.
