Mr.
Sherman made a presentation on the administration’s plan for a comprehensive
review of the City’s fee structure, which he said has not been done in at least
the last 38 years. He reviewed the wide variety of fees the City charges which
fall into 3 broad categories: enterprise unit fees (recouping all costs of the
operation for services that the public may or may not use); direct service fees
(covering most or all incremental costs of a function, with administrative
overhead costs borne by the general government); usage fees (may be variable to
control usage rates – i.e. peak time pricing or out-of-county fees). Mr.
Sherman said the department will make quarterly reports to the Finance
Committee over the course of the 12 months that the review process will take.
The end result will be a web site showing every City fee with links to
ordinance and statutory fee authorizations and links to the departments, offices
and agencies that charge the fee. Council Member Becton suggested that this
review process could be an opportunity to help council members understand where
all the fee revenues are deposited and how they are used, whether into a
specific account for specific uses or into the General Fund as one of many
revenue sources. In response to a question from Council Member Boyer, Mr.
Sherman said that some Ordinance Code changes will be needed at the end of the
process to codify a new fee system. In response to a question from Chairman
Dennis, he said that the fees are set at a level to recoup costs and not to
generate any excess “profit”, although there generally is not a prohibition
against doing so.

moratorium on City operations, CFO Mike Weinstein said that the City is not
collecting $88,000 to $100,000 per year and has been laying off employees in
the vehicle inspection division. He cautioned that there may be public safety
impacts from the lack of vehicle inspections and regular inspections of taxis.
Council Auditor Kyle Billy said that the City did not budget any revenue for FY2017-18
but the fund is still solvent. Deputy General Counsel Peggy Sidman said that
the state legislature preempted regulation of TNC companies (Uber and Lyft) to

revenues will be deposited and how it will be used. She has been told by the
Parks and Recreation Department that it will be deposited into the Parks
Partnerships account and used for its authorized purposes. Assistant Council
Auditor Kim Taylor said that the naming rights agreement (but not the bill)
says that the revenue will go into the Parks, Recreation and Community
Services Trust Fund (Sec. 111.105(b), Ordinance Code) which subsequently
references the Parks Partnership implementing policies established in
Ordinance 2017-352-E. Boyer
amendment: insert reference within the agreement that the future
appropriation and use of these funds will be done in accordance with the guidelines
of the Parks Partnership program (which makes it self-appropriating for
expenditures of $100,000 or less) – amendment

Billy said that the Auditor’s Office had received the draft report from the
administration and returned it with several comments and questions in a timely
