Mayor’s Travel Audit Follow-up Report
Mr. Billy said that 16 issues were
identified in the original audit, which covered a time period during the Mayor
Alvin Brown administration. The follow-up was conducted on practices effective during
the Mayor Lenny Curry administration. 13 of the 16 issues have been completed
and the remaining 3 will be reviewed by the Accounting Division, which manages
travel regulations, during 2018.
JEA Presentation on Backflow Program –
Jordan Pope
Mr.
Pope explained the need for backflow prevention devices on irrigation systems,
which have been required by state regulation since the 1990s. JEA is required
by a recent change in state regulations to report on compliance with the rule
by its customers and is designing a program to meet that requirement. JEA has
approximately 32,000 irrigation meter customers and plans to roll out the
compliance program to customers over the course of the next 2 years. Customers
may either have a JEA-contracted plumber perform the test and provide the
certification or can hire their own contractor and submit the results to JEA.
If the backflow test fails or if there is no backflow preventer installed, the
customer will have at least 30 days to comply with the regulations. No
enforcement action will be taken for at least 180 days after a violation is
determined. Council members posed questions about the testing process, the cost
of repairing existing or installing new backflow preventers and how the JEA
intends to work with customers who have compliance issues. In response to a
question, a JEA representative said that state regulations require that tests
be performed by a certified backflow prevention tester, so a homeowner could
potentially pull a plumbing permit and install or repair their own backflow
preventer, but the subsequent test would still require a certified tester
before the results could be accepted.
Council
Member Becton suggested that above-ground backflow preventers pose more of a
risk to the safety of the water supply than below-ground piping, adding a
potential for liability, and that the state regulation is counter-productive to
promoting safety. Council members asked the General Counsel’s Office to
investigate the possibility of the City opting out of or refusing to comply
with this DEP regulation. Mr. Pope explained the rationale for using an
irrigation meter to avoid the sewer charge versus using water run through the
household meter for irrigation. Council Member Schellenberg advocated for
sending a message to the Florida Legislature to stop imposing unreasonable
mandates on local governments and state residents.
Chairman
Dennis noted that during the FY17-18 budget process the budget ordinance waived
the requirement that the administration automatically adjust City fees at the
start of the fiscal year as a result of an annual fee study and gave the
administration until January 31, 2018 to complete the study and report the
results. Ali Korman Shelton of the Mayor’s Office said that the study is nearly
complete and should be finished in February.

Member Boyer distributed a redline version of a proposed substitute for the
ordinance and how it relates to the Sports Complex sign overlay zone in the
Zoning Code with regard to on-site and off-site signs. Dave Herrell, Sports
and Entertainment Officer, explained that the Jacksonville Jaguars have
indicated that they are agreeable with amending Amendment 14 of the stadium
lease to delete any reference to the team constructing up to 3 signs in the
Sports Complex; there would only be 1 City-constructed and –operated sign.
Council Member R. Brown requested Mr. Herrell to provide information on cost
overruns in the $90 million stadium improvement project 2 years ago ($45
million City, $45 million Jaguars) that were borne by the Jaguars. He
believes those excess costs may have contributed to the Jaguars not
constructing the signage they had the right to construct. Assistant Council
Auditor Kim Taylor said that the City owns the stadium improvements (Everbank
Field, Daily’s Place amphitheater, Covered Flex Field) and should be able to
easily access the book value of those assets to verify their construction
costs. Council Auditor Kyle Billy agreed to provide research on the project
cost and the City’s contribution. Council Member R. Brown suggested an amendment
to permit advertising of City events not occurring within the Sports Complex
overlay zone on the new sign. John Sawyer of the General Counsel’s Office
explained the intricacies of the Sports Complex overlay and said that the
pending ordinance cannot be used as a vehicle for allowing advertising of
non-Sports Complex events. Ms. Boyer said that amending the Zoning Code for
that purpose would entail a larger discussion with constitutional sign
regulation ramifications. Council
Member Boyer offered a substitute that incorporates the Council Auditor’s
marked amendment (correcting scrivener’s errors) and adding several
clarifications about the location and permitted uses of the new sign. -
Amendment
14 of the Jaguar Lease included the construction of up to three video board
marquees. -

still have the option to build up to three marquees -
