In attendance: Council Members Matt Schellenberg (Chair), Al Ferraro, Lori Boyer, Danny Becton

 

Also: Susan Grandin – Office of General Counsel; Jeff Clements – Council Research Division; Crystal Shemwell – Legislative Services Division; Folks Huxford, Bruce Lewis and Kristen Reed - Planning  and Development Department

 

Meeting Convened: 1:00 p.m.

 

Chairman Schellenberg called the meeting to order and asked the attendees to introduce themselves for the record.

 

Mr. Schellenberg reviewed the Auditor’s marked agenda which included 11 items marked for deferral, 11 items to have the public hearing opened and continued, 19 items ready for action (2 to be substituted, 1 to be withdrawn) and 2 items for second reading and re-referral.

 

2017-703 (small scale land use amendment on Myrtle Avenue): Council Member Boyer asked for an explanation of the rationale for the change back to CGC from RPI, when the property was changed from RPI to CGC some years ago.

 

2017-831 (small scale land use amendment on Hare Avenue) will have the public hearing opened and continued to May 15th while notices are sent out. Council Member Boyer asked Planning staff to have a conversation with the applicant about the proposed land use category.

 

2017-832 (rezoning on Hare Avenue): Ms. Boyer asked Susan Grandin and Planning staff to redraft a line in the written description which she believes is poorly written.

 

2018-75 (Zoning Code amendment regarding medical marijuana dispensaries) will be taken up first with the public hearing opened and continued. Sondra Fetner of the General Counsel’s Office will be available for questions.

 

2018-131 (road frontage waiver on West Shark Road): Council MemberBecton asked if the front and back parcels are in different ownership and, if so, when and how that occurred. Folks Huxford will research and have information at the meeting. Ms. Boyer has asked for information on setbacks, viewsheds, etc. in the Comprehensive Plan since this property is readily visible across a water body from the Timucuan Preserve.

 

2017-832 (rezoning on Hare Avenue) will be deferred.

 

18-147 and -148 (land use change and rezoning on West Meadow Road): Council Member Boyer said these are in the Great Meadows DRI which has master developer commitments to provide recreational facilities; she asked staff to determine how those commitments are being addressed as the DRI is being subdivided into small parcels.

 

2018-156 (sign waiver on Park Street): Ms. Boyer said that bill needs to be amended to change the bill title to reflect what the bill is actually doing; the original title is somewhat misleading.

 

2018-58 (Authorizing Gen Counsel to investigate & commence litigation to enforce the Zoning Code associated with property on Grover Rd): In response to a question from Council Member Becton, Council Member Ferraro explained that the bill is intended to deal with non-compliance with conditions and with a house built in an improper location. Ms. Grandin said that each of the Whereas clauses in the resolution explains a violation of a PUD condition.
