Presentations:
Allison Hewitt, Department of Health,
provided an update on the Zika virus. Due to the decrease in exposure reports,
the Zika Hotline has been disconnected and inquiries will be reverted to the
website.
Joseph Mims, Department of Health, stated
there were four major initiatives to assist with outreach: RAPID ACCESS (Test
& Treat); PrEP (Pre-Exposure Prophylaxis); Outreach Program; and Routine
Testing through hospitals and doctor offices.
Kurt Wilson, Fire Chief, provided the
committee with a brief overview of 2017 and 2018 projections. The 2017 final
report will be presented at a later meeting.

Comments,
Concerns and Amendments
Summary:
This bill is for the assignment, assumption,
modification and subordination of two loans, a State Housing Initiative
Partnership (SHIP) loan agreement and a HOME loan agreement, on the property
located at
Concerns:
1. The City is giving up its first
position as a lienholder on the property on the SHIP loan with an assessed
value of over $3 million.
2. Once the first lienholder
position is given up, there are no clawback provisions for the City to gain the
first position back.
3. There are no provisions in this
legislation that guarantee that the property is redeveloped. However, in the loan documents to be provided
and placed on file, the Office of General Counsel has indicated they will have
provisions concerning the commencement and completion of the Development
Project to address this.
4. There are no provisions in this
legislation that guarantee that the property will be sold to and redeveloped by
a private entity. Therefore, there is no guarantee that this will become
taxable property on the tax roll. However, even if developed by a private
entity, that private entity could apply for Historical Property Tax Exemption
once development is completed.
Amendments:
1.
Place the core loan document forms (i.e., amended and restated
note, assignment and assumption, and HOME and SHIP loan agreement, covenant and
restriction) on file. Authorize Mayor to
execute all other standard loan documents necessary to effectuate the
transaction as form approved by the Office of General Counsel (i.e.,
subordination or intercreditor agreement, affidavits, assurances, etc.).
2.
Attach SHIP and HOME loan modification terms as an Exhibit.
a.
SHIP Loan modification terms as follows: (Effective Modification Date – November 25, 2017; New Maturity Date
– November 25, 2027; 10 year term; Principal Amount - $134,279.91; Forgiveness
- 1/10th percent forgivable each year (i.e., $13,427.99) on November
1st (beginning 2018); Interest - 0%; 2nd Lien position; New Development
Project to commence in 2 yrs and complete in 3 yrs from commencement date; Land
Use Restriction Agreement 15% of the units at 80% AMI (rent and income) for ten
years and downtown development requirements).
b.

Use Restriction Agreement 15% of the units at 80% AMI (rent and income) for ten
years and downtown development requirements).

Delete the loan terms in the bill and make reference to the loan
terms more particularly described on the loan terms Exhibit

the purchase and sale agreement expiring on or before January 31, 2018.
