Summary NCSPHS: Withdraw 4-1 approve to withdraw (CM Crescimbeni in opposition) There was some discussion about this bill, which was
initially introduced by Councilwoman Katrina Brown and subsequently
co-sponsored by CMs Dennis and Hazouri. CM Hazouri wanted the bill to be
withdrawn, re-drafted and then
introduced again, but CM Dennis recommended deferral to allow time for input
from homelessness organizations. CM Crescimbeni agreed that the bill should
incorporate policy recommendations from homelessness advocates and that a
meeting should be noticed to iron out all of the details before voting to
withdraw the bill. |

attendance to speak about this bill which was intended to provide funding for
early voting sites on two college campuses. The SOE has determined that it is
possible to hold early voting at the two sites, but does not need Council
funds to do so. The bill is being withdrawn because the SOE will utilize
existing federal funds to cover the costs for the campus early voting sites.
CM Hazouri asked about the possibility of getting closer to Election Day and
the SOE not having enough funding available to open the sites, but Mr.

Steve Durden, Office of General Counsel, was present to
speak about an email received by all council members from JALA (Jacksonville
Area Legal Aid) in reference to enacted legislation (2018-104) and fees associated
with the foreclosure registry. The Foreclosure Registry is a web-based electronic
database of searchable real property records, used by the City of Jacksonville
to allow mortgagees the opportunity to register defaulted properties and pay
applicable fees. At the
time of initial registration each registrant pays a non-refundable annual registration
fee for each registered defaulted property. Those fees, and any other fees
incurred for noncompliance or late registration, are designated to be used for
the costs of implementation and enforcement of the ordinance but not the legal
defense of foreclosure actions. JALA expressed interest in new legislation
which would permit the fees to be used to assist with mortgage payments, but
according to Mr. Durden the fees may not be used in that manner and the
proposed legislation for fee usage would never be upheld in court.
Peggy Sidman, Office of General Counsel, spoke about more
proposed Council Rule changes, as submitted by Councilman Anderson. CM Anderson
suggested that the committee consider aspects of four Council Rules 4.301(c),
3.103 (a), 3.603 and 3.601(a) and the speaker card process in council meetings
·
Council
Rule 4.301(c): pertains to presentations during council meetings. According to
the rule, there should be no more than two, including presentations, in each
meeting. However, in practice that number has been greater than two, which
detracts from the time for addressing legislative business. Per the committee
discussion, it was suggested that the rule of two be enforced or that a time
limitation be implemented for time management. It was also mentioned that there
be some sort of per council member allotment so all members have an equal
opportunity to make presentations. It was requested that Ms. Sidman compile a
list of all resolutions written (to honor, commend or mourn the passing of
individuals) in 2018, as well as a list of all resolutions formally presented
during council meetings for the same time period. Tangentially in this discussion, CM Boyer
mentioned unfiled resolutions, which are used ceremonially by some council members,
and inquired about the Council Rule or other authorization source which makes
them permissible. It was agreed that such documents should take a different format,
like a letter or certificate, instead of that of a legal resolution, since they
are not actual resolutions voted upon by the body as a whole.

Council
Rule 3.103 (a): pertains to the introduction of bills. Currently there is a
practice of removing items from the consent agenda to add council members’
names to legislation by amendment. To prevent this, there are several other
methods and times by which co-sponsors can be added, prior to council meetings.

Council
Rules 3.601 (a) and 3.603: pertain to public hearings and comments from the
public during council meetings. To streamline the process, it was suggested
that the speakers sit in the front rows of council chambers, provide 3:05 for
speaking and start the clock once the name is called. It was uncertain how to
specifically explain these rules to the public to prevent confusion.

Speaker
card process: The consensus is that the
current method of using speaker cards for public comment and public hearings is
antiquated and cumbersome. Dr. Cheryl Brown and Louie Marino, City Council,
were present to discuss possible electronic queue alternatives as used by the
Tax Collector’s Office or the Clerk of Courts. There was some concern about the
cost, but primarily the challenges to implementing such a system are based upon
the intricacies of the council proceedings. It was agreed that more research should
be done to find an appropriate manner for modernizing the process. There was
also some discussion about the parameters for the public who have chosen to
speak. According to Rule 3.605, members of the public may speak for the
allotted time, but it is not intended to be a back and forth discussion between
the individual and members of council. In the past this rule has not been
strictly adhered to, but under current council leadership, it is being
observed. The perception to some members of the public is that their input is
not being prioritized and that their questions are not being answered. The
intent of the public comment period is not to hold a dialogue, but to allow the
public to speak on behalf of a bill or issue to the council as a whole.
Before adjourning the meeting, the
committee agreed to form a subcommittee to further assess these procedural
issues and other Council Rules as necessary. Council Members Crescimbeni, Boyer
and Anderson were identified as members for the subcommittee.
