Presentation by Peggy Sidman - Council Rule 4.504 (Manner of Speaking)

Ms. Sidman spoke about several Council Rules and again asked the committee members to submit proposed Rule changes for future discussion. There was discussion among the committee members about Council Rules 4.504, Rule 3.605, and Rule 3.603, which apply to the manner of speaking during council meetings, addressing the council and public comment. The committee members concurred that there should be clear and uniform procedures for the application of these Council Rules and that the public should be well informed during meetings about procedures. There were some questions about whether council members could ask questions or engage in debate with speakers during public comment and public hearings, and about whether public speakers should adjourn to the green room if more conversation is needed on legislation or issues. Ms. Sidman indicated that she would look further into whether the rules for public hearings and public comment need to be the same. CM Anderson also noted that the public speaker cards are outdated and that an electronic queue should be researched for the near future.

CM Crescimbeni asked numerous questions about this bill, which changes travel protocol for TDC contractors. The current protocol is cumbersome for TDC contractors, who have been required to follow state statutes and the City’s travel policy. The TDC wants more discretion for reimbursement due to the nature of the travel industry. CM Crescimbeni expressed concerns about oversight and accountability if the TDC crafts its own travel rules for contractors, as the rules will not be subject to Council approval.

 

As Substituted and Re-referred, this bill now:

 

1.       Corrects scrivener errors  in legislation and Exhibit 1

2.      Includes “incidental expenses” in the definition of Travel Expenses to mirror Florida Statutes

3.      Adds language that requires the travel schedule be included in the contractor’s annual plan approved by the TDC

4.      Adds language that the TDC, in its discretion, may only advance pay or reimburse the Travel Expenses in accordance with the annual travel budget and annual travel schedule approved by the TDC and that any amendments will require TDC approval

5.       Clarifies that any rules that the TDC develops regarding Travel Expenses must be consistent with tourism industry practices

6.      Adds language that food and beverage expenditures must also be consistent with annual budget and annual plan approved by TDC
