The measure’s sponsor, Council Member John Crescimbeni, explained what the proposed legislation entailed and provided some background.  Mr. Crescimbeni explained that a while back, the Public Trust Environmental Legal Institute of Florida brought a lawsuit against the City of Jacksonville.  The lawsuit contended that the City of Jacksonville failed to fully utilize the Tree Protection & Related Expenses Trust Fund; there was a considerable amount of funds in the Trust Fund for planting trees but the City of Jacksonville was lax in doing so.  A settlement provided for the creation of the Tree Commission to facilitate a process for enhancing the City’s canopy of trees.  The proposed legislation that creates a two-prong method for planting or replacing trees is the work of the Tree Commission.  There will be additional proposed legislation from the Tree Commission that is forthcoming that would enable non-profits and civic groups such as the Rotary Club to partner with the City for tree planting projects on City-owned public property.

 

Council Member Danny Becton was concerned that District Council Members were out-of-the loop when citizen or civic group tree planting projects were initiated.  He saw nothing in the proposed legislation that could provide a District Council Member with an opportunity to weigh in.  Public Works Director John Pappas did not think that it would be a problem for the Public Works Department to keep Council Members abreast of initiatives for tree planting projects in their respective districts.

Though the Council Auditors Office marked agenda had this and the following items marked as ready for action, it was decided to defer the items when Council Member John Crescimbeni brought to the panel’s attention how the appropriation figures had skyrocketed. Public Work Department Director John Pappas explained that the contract that the City had long had with a particular contractor for tree planting and maintenance had expired.   The new bidder’s prices for the same work were substantially higher than initial estimates and quotes.
