Council Member Garrett Dennis, the measure’s sponsor, explained what the status of the proposed legislation is. He reported that he had conferred with the agent and had spoken with residents and businesses on Robinson Avenue.  Heather Reber explained what the Council Auditor’s Office amendment entailed.   Council Member Dennis indicated that he will offer an amendment at the Rules Committee to

specify that the street name change will affect two (2) blocks of Robinson Avenue.  Several of the other members of the Committee requested that their names be added as co-sponsors of the ordinance.

-          Requires waivers of any requirement or design standard to be heard by the appropriate committee of Council instead of the approval by the Director of any waiver

-          Includes design standards for Collocation on existing poles in City rights-of-way and Small Wireless Sole Purpose New Utility Poles

-          Exempts out communications equipment owned/used by governmental entities

-          Adds an intent section to explain the Council’s intentions regarding the enactment of the legislation

-          Establishes a pre-approval requirement for applicant’s use of JEA infrastructure before such application can be approved

-          Establishes evidence requirements for deviations from the collocation requirement

-          Corrects scriveners errors  and clarifies definitions

 

 

A host of speakers addressed this item and engaged in questions.

 

Attorney Paul Harden, representing Unity, explained five amendments to the third substitute  that he and Deputy General Counsel had worked on and reached an accord.  Council Member John Crescimbeni amended one of those proposed amendments to reduce the maximum size of the wireless antennae cabinets  from 10 cubic feet to 6.7 cubic feet.  Council Member Crescimbeni had repeatedly voice concern about the aesthetics of the wireless apparatus as potentially marring the landscapes of neighborhoods.

 

Deputy General Counsel Jason Teal fielded questions.

 

Jordon Pope, JEA Director of Government Relations, fielded questions and explained JEA’s position on the proposed legislation.

 

Heather Duncan, representing AT&T fielded questions and explained the wireless industry’s view, understanding and concerns about the wireless apparatus proposals.

 

Adam Oliver, representing Verizon, expressed Verizon’s concerns ab0ut various aspects of the proposed legislation.

 

Council Member Boyer explained that the proposed legislation emanated from the deliberations of the working group that had numerous workshops.  She noted that from the outset, those that crafted the legislation focused on aesthetics.  She explained that nothing in the proposed legislation was new.  Rather, the group looked at what other jurisdictions throughout the state had considered and adopted for wireless antennae apparatus that complied with the requirements of the State of Florida.

Council Member Reggie Gaffney, the ordinance’s sponsor explained that he had insisted on the purchase of Date Palms for the project because if reflected the wishes of his constituents who feel that Date Palms would improve the appearance of the community.  Council Member John Crescimbeni had contended that the Tree Commission had implored the City to abandon the purchase of Date Palms because they were costly, were not the right kind of tree for North Florida, were short-lived and emitted a fungus injurious to the terrain.  Dave McDaniel, Chief, Mowing and Maintenance Division, Public Works Department, fielded questions about  Date Palms.

3.      Adds a new section to authorize the execution without further Council action of future landscape maintenance agreements in substantially the same form attached as Revised Exhibit 1 between the City and third parties to allow third parties to maintain landscaping projects within FDOT Rights-of-Way

4.      Provides for oversight by Dept of Public Works

5.       Clarifies that this ordinance supersedes the previous standard maintenance agreement form authorized by Resolution 2004-1371-A

6.      Attaches a Revised Exhibit 1 (Maintenance Agreement) to:

·         Clarify that Trinity shall pay water and electric fees for the systems

·         Clarify natural disaster clean-up responsibilities for Trinity and the City

·         Clarify that Trinity pays for cost to remove the fountains if agreement is terminated due to Trinity’s failure with terms of the agreement

·         Add new Exhibits C (Maintenance Standards), D (Indemnification) and E (Insurance Requirements)

IN Public Comment, Mr. Michael Jester lamented that the City has persistently avoided maintenance work on a drainage easement on his property.  The Chair explained to Mr. Jester that the City’s Public Works Department was ready and willing to do the maintenance work but were barred because of his persistent unwillingness to sign an agreement that would enable the City to access his property.
