Amendment

(ORD-Q Rezoning at 0 Starratt Rd. & 0 Lord Nelson Blvd btwn Airport Center Dr East & Bonaparte Landing Blvd from PUD to PUD): rezoning approved subject to conditions:

1.      With 78 residential units proposed and residential uses limited to 80 percent of a development in the CGC category, the development shall be required to provide a minimum of 15,000 square feet of nonresidential uses;

2.      If the entrance is to be gated, it shall be designed such that vehicles waiting for the gate shall never queue into the public roads. A queuing study shall be included in the site plan review. A turnaround shall be provided so that drivers at the gated entrance who do not have access will not have to back out into the public street;

3.      This development is subject to mobility fee review;

4.      All comments or conditions made by Transportation Planning Division or Traffic Engineering Division are required PUD/Zoning conditions of the Transportation Planning Division unless otherwise waived in writing by the Chief of Transportation Planning Division or waived by Planning Commission, LUZ Committee, or City Council;

5.      Pursuant to Policy 4.1.5 of the Transportation Element of the 2030 Comprehensive Plan, the applicant must provide for the convenient and safe access by and securing of bicycles on site. The bicycle parking must be consistent with the requirements outlined in Part 6 of the Zoning Code;

6.      The Developer shall limit initial investor sales to no more than ten (10) units of the development.  Additionally, the Homeowners’ Association documents shall prohibit all short term rental of thirty (30) days or less within the development;

7.      All lighting along the rear of the townhomes which are located along the lake (units 49 through 78 on the Revised Site Plan dated December 28, 2018) shall be designed and installed to localize illumination onto the Subject Property in order to minimize impacts to the adjacent residential uses;

8.      Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order.

(ORD-MC Amend Chapt 656 (Zoning Code, Part 3 (Schedule of Dist Regs), Subpart F (Planned Unit Development), Sec 656.341 (Procedures), Ord Code, to Amend existing requirements for Applications for Planned Unit Development to provide additional information within the PUD Application, including Waivers or Deviations requested in the Application, and adding additional criteria for Minor Modifications to a PUD):

The sub requires requests for deviation from or waiver of Zoning Code requirements in a PUD to explain why each requested deviation or wavier is necessary. It clarifies at what point the developer must identify the legal entity that is maintaining the common areas of the PUD and corrects scrivener’s errors in the language in new additions to subpart (ii), (iv) and (v) of Section 656.341(f)(2) concerning when a minor modification application can be made and when a major modification is required if language is revised from the original application.

(ORD-Q Rezoning 12721 & 12743 Atlantic Blvd btwn Girvin Rd & Home Depot Dr from CCG-1 and PUD to PUD): rezoning approved subject to conditions:

1. All sag lenses, drop lenses and convex lenses shall be prohibited. Illumination levels at all property lines shall not exceed one (1.0) f.c. when abutting non-residential properties or public rights of way. All lighting lamp sources within parking and pedestrian areas shall be metal halide, compact fluorescent or LED. The developer shall mount light fixtures on canopies so that the lens cover is recessed or flush with the bottom surface (ceiling) of the canopy. An exterior lighting design plan, including a photometrics plan, pole and fixtures schedules shall be submitted at the time of Verification of Substantial Compliance for review and approval by the Planning and Development Department.

2. This development is subject to mobility fee review.

3. Access to the site via Atlantic Boulevard (SR 10) must be subject to FDOT access management guidelines.

4. Prior to the first final inspection within any phase of development, the owner or their agent shall submit to the Planning and Development Department for its review and approval either (a) an affidavit documenting that all conditions to the development order have been satisfied, or (b) a detailed agreement for the completion of all conditions to the development order.

(ORD Auth Interlocal Agreemt Continuing the First Coast Workforce Development Consortium (2016 Interlocal Agreemt) bet City & Counties of Baker, Clay, Nassau, Putnam & St Johns):

1. Removes language authorizing and approving a new interlocal agreement.

2. Authorizes the City to continue participating in the existing 2016 interlocal agreement for an additional six years through August 14, 2024.
