Bill Summary: This bill amends section 656.129, Ordinance Code, to require that, if the Planning and Development Dept. report and recommendation changes after the Planning Commission has made its advisory recommendation to the Council, then the proposal to amend the Zoning Code or rezone land shall be remanded to the Planning Commission for further consideration and another advisory recommendation. Section 650.404 is similarly amended to require that, if the Planning and Development Dept. report and recommendation changes after the Planning Commission has made its advisory recommendation to the Council, then the application to amend the comprehensive plan shall be remanded to the Planning Commission for further consideration and another advisory recommendation. Likewise, Section 650.405 is amended to require that, if the Planning and Development Dept. report and recommendation changes after the Planning Commission has made its advisory recommendation to the Council, then the application to amend the comprehensive plan shall be remanded to the Planning Commission for further consideration and another advisory recommendation, following public hearing procedures. The Legislative Services Division is directed to forward a copy of this ordinance, as enacted, to the Municipal Code Corporation.

Background Information: These changes are intended to allow the Planning Commission’s recommendations to be based on the best available data and analysis provided by the City’s professional staff. When department reports or recommendations are changed after the Planning Commission has made a recommendation, the Planning Commission will be given the opportunity to review the new information and potentially change its recommendation.
