Bill Summary:  This bill approves the settlement between the City and THS Investments, Inc., relative to a Cleveland Ash Site remediation costs claim.  The Office of General Counsel is authorized to execute necessary documents.

 

Background Information:  The settlement requires no appropriation as funds are available for this purpose in the Better Jacksonville Plan Environmental Cleanup accounts.  Under the terms of the settlement, the City will pay THS Investments $120,000; THS Investments will execute a release agreement; and, the parties will each bear their own costs and attorney’s fees, splitting the cost of mediation.  THS Investments paid for incinerator ash remediation on property adjacent to the 5th and Cleveland Ash Site in order to continue with its building program and avoid delay costs.  The City was responsible for site remediation, and THS Investments has made claim to recover its costs.
